Offsite Japan Terms & Conditions

These Commercial Disclosures / 特定商取引法に基づく表記 / Terms & Conditions (“Terms”) govern your access to and use of the Offsite educational programs and related services (“Services”).

Offsite Japan and Advanced Design operate in partnership and are provided and administered under the legal entity:

Throughout these Terms, 「 yes, 」YES AND 合同会社, Offsite Japan, and Advanced Design may be referred to collectively as “Offsite,” “we,” “us,” or “our,” unless the context requires otherwise. https://yesand.design / offsitejapan@yesand.design

By enrolling in or using the Services, you agree to be legally bound by these Terms. If you do not agree, you must not enroll in or use the Services.

If you are under 18 years of age, you represent that you have obtained the consent of a parent or legal guardian.


Online Course Provider

1.  Definitions

“Confidential Information”
Means any non-public information disclosed by one party to the other in written, oral, digital, graphic, recorded, or machine-readable form relating to business operations, clients, suppliers, course content, or materials, including Course Materials. Confidential Information does not include information that is publicly available through no fault of the receiving party, lawfully obtained from a third party, or required to be disclosed by law or court order.

“Course Materials”
Means educational materials, content, documentation, recordings, and resources provided as part of an Offsite program.


“Paid Services”
Means any Offsite course or program that requires payment.


“Payment Processor”
Means Stripe or another third-party payment service designated by Offsite.


“Website”
Means the official website(s) operated by Advanced Design and/or Offsite, including advdes.org and any affiliated pages.


“User”
Means any individual who accesses or uses the Services, Course Materials, or content.


2.  Indemnification
To the extent permitted under Japanese law, you agree to indemnify and hold harmless Offsite, its officers, directors, employees, instructors, and agents from and against any reasonable claims, damages, losses, or expenses arising directly from your breach of these Terms or unlawful use of the Services.

This indemnity shall not apply to losses caused by Offsite’s willful misconduct or gross negligence.


3.  Services
Descriptions of the Services, Course Materials, schedules, and start dates are provided on the Website or in official enrollment communications.

Offsite will provide the Services with reasonable care and skill in accordance with generally accepted professional standards.


4.  Changes and Availability
4.1 Offsite reserves the right to modify, reschedule, or discontinue any Service, instructor lineup, or Course Material where reasonably necessary.


4.2 Offsite does not guarantee any specific educational, professional, or employment outcome as a result of participation.


4.3 You are responsible for confirming that the Services meet your personal and professional needs prior to enrollment.


5.  Payments
Payments for Paid Services are processed through a third-party Payment Processor.

By enrolling, you authorize Offsite to charge the applicable fees using your selected payment method in accordance with the Payment Processor’s terms.

All tuition fees must be paid in full no later than 72 hours prior to the start of the program, unless otherwise agreed in writing.

Offsite is not responsible for errors caused by the Payment Processor.


6.  Cancellation & Refund Policy
All tuition payments are non-refundable, except where required by applicable Japanese consumer protection laws.

Once payment is made, it is not eligible for refund, credit, or transfer under any circumstances, including non-attendance or withdrawal by the User.


7.  Technical and Device Requirements
Participation requires access to a modern desktop or laptop computer capable of running professional design software, including but not limited to Autodesk Fusion 360, KeyShot, and Adobe Creative Cloud.

Devices, software licenses, and internet access are the sole responsibility of the User.


8.  Intellectual Property and Use Restrictions
 All Course Materials and educator content are protected under Japanese copyright law and international treaties.

Users may not copy, reproduce, distribute, share, or publicly display Course Materials without prior written consent.

Unauthorized redistribution may result in immediate termination without refund and potential legal liability.


9.  Use of Student Work for Promotion
You retain ownership of all original work you create during the program.

You grant Offsite a non-exclusive, worldwide, royalty-free license to use your work, name, and likeness for marketing, promotional, and archival purposes, unless you notify Offsite in writing of an objection prior to publication.


10.  Accessibility and Accommodations

Offsite will make reasonable efforts to use accessible digital tools and to accommodate disclosed accessibility needs, where practicable.

Requests must be communicated during the application process.


11.  Code of Conduct

All participants must maintain a respectful, inclusive, and professional environment.

Harassment, discrimination, intimidation, or inappropriate conduct of any kind will not be tolerated.

Offsite reserves the right to remove participants who violate this policy, without refund.


12.  Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan.

Any dispute arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the Tokyo District Court, unless otherwise required by applicable law.
