Offsite Terms & Conditions

These Terms of Use (“Terms”) constitute a binding agreement between you and Advanced Design. and its affiliates and subsidiaries (“Advanced Design,” “Offsite” “we,” “us”). Please read these Terms carefully before using the Service (defined below). Your use of the Offsite Service signifies your agreement to be bound by these Terms each time you access Offsite by Advanced Design. If you do not agree to any of these Terms, do not enroll to Offsite by Advanced Design. If you are under 18 years of age, you represent and agree that you possess the legal consent of your parent or guardian to access and use Offsite by Advanced Design.


Online Course Provider

1. DEFINITIONS
“Confidential Information” means information provided by one party to the other in written, graphic, recorded, machine readable or other form concerning the business, clients, suppliers and other areas of the other party’s business or products, including but not limited to Course Materials, but does not include information in the public domain other than through the default the party disclosing the information, information required to be disclosed by any court or regulatory authority, or any information already in the possession or control of the disclosing party.

“Course Materials” means the information provided by Offsite by Advanced Design to accompany a course provided.

“Paid Services” means the service (Offsite educational platform) that users are able to access.

“Payment Processor” Means our payment method or third-party payment service.

“Website” means Advanced Design’s official website that houses information regarding Offsite (advdes.org).

“User” means those accessing our paid services, course materials & Content.

2. INDEMNITY
You agree to defend, indemnify, and hold Offsite by Advanced Design, its officers, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your violation of this Agreement, your use of the Services, and any claim made by a third party as a result of your use of the Services, including any claim alleging your infringement upon the copyrights, trademarks, trade secrets, patents or other intellectual property rights of such third party.


3. SERVICES
A description of the Services and Course Materials  together with the dates on which the Services will begin are available on our Website.  We will provide the Services with reasonable care and skill in accordance with the description set out on the Website.

We reserve the right to withdraw any of the Services described on our Website and Acceptance package without notice.

3.3
We expect you to confirm that the Services you are purchasing will meet your needs.  We do not make any guarantee to you that you will obtain a particular result, professional qualification or employment opportunity from your purchase and completion of any of the Services.


4. PAYMENT
We use a third-party payment processor named Stripe (the “Payment Processor”) to bill you for the full amount of Offsite Services. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to this Agreement. We are not responsible for error by the Payment Processor. By choosing to use Paid Services, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for any use of such Paid Services in accordance with the applicable payment terms and you authorize us, through the Payment Processor, to charge your chosen payment provider (your “Payment Method”). You agree to make payment using that selected Payment Method. We reserve the right to correct any errors or mistakes that it makes even if it has already requested or received payment. We reserve the right to refuse service without payment.

Payment Method. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method. If we, through the Payment Processor, do not receive payment from you, you agree to pay all amounts due on your Billing Account upon demand.

By agreeing to these Terms & Conditions, you are agreeing to pay for the full amount of tuition that is not covered by scholarship. Payments must be submitted 72 hours before the start of the program.

Free Trials and Other Promotions. Any free trial or other promotion that provides access to a Paid Service must be used within the specified time of the trial. You must stop using a Paid Service before the end of the trial period in order to avoid being charged for that Paid Service. If you cancel prior to the end of the trial period and are inadvertently charged for a Paid Service, please contact us here.


5. CANCELLATION & REFUNDS
All tuition payments to Offsite by Advanced Design are Non-Refundable. Any payments made by the User in accordance with this Agreement shall, once they are paid, not be refundable nor creditable for any reason whatsoever.


6. DEVICE REQUIREMENTS
Offsite by Advanced Design is a modern learning platform. Your participation requires you to have or have access to a current desktop/laptop computing device with minimum system requirements to run design software such as but not only Autodesk Fusion 360, Keyshot, and Adobe CC. Device and software will be provided by you the student and will not be the responsibility of Offsite by Advanced Design. In addition, all students must have access to high-speed internet with the ability to run video conferencing apps with a reasonable amount of stability.


7. ARBITRATION
These Terms and the relationship between you and Offsite by Advanced Design shall be governed by the laws of the state of Illinois without regard to its conflict of law provisions, regardless of where you live. You and Offsite by Advanced Design agree to submit any disputes relating to your use of the Offsite by Advanced Design Service for final and binding arbitration under the rules of the American Arbitration Association. Any such arbitration, to the extent necessary, shall be conducted in Chicago, Illinois. You covenant not to sue Offsite by Advanced Design in any other forum.

You also acknowledge and understand that, with respect to any dispute with the Released Parties arising out of or relating to your use of the Offsite by Advanced Design Service or these Terms:

YOU ARE GIVING UP YOUR RIGHT TO HAVE A TRIAL BY JURY;

YOU ARE GIVING UP YOUR RIGHT TO SERVE AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS, IN ANY LAWSUIT INVOLVING ANY SUCH DISPUTE; AND

YOU MUST FILE ANY CLAIM WITHIN ONE (1) YEAR AFTER SUCH CLAIM AROSE OR IT IS FOREVER BARRED.


8. LIMITATION ON USE
Offsite and its educators have gone to great lengths to produce high value content. All educator content is the intellectual property of Advanced Design. Any reproduction and distribution in any form is expressly prohibited. If any student is caught redistributing materials to non-students in private or in any digital capacity on-line or otherwise, that student is subject to immediate termination with no refund. In addition, such student may be liable for lost revenue and damages based on an estimation by Advanced Design of views of proprietary materials at the sole discretion of Advanced Design’s legal council.


9. RELEASE OF WORK FOR MARKETING
As a student of Offsite, all work you produce in conjunction with Offsite by Advanced Design courses are your sole property. You give Offsite permission to use your work, likeness and any other outputs in future Offsite promotional and marketing materials at Offsite’s sole discretion.


10. ACCESSIBILITY
Offsite to the best of its ability will use digital tools which meet a minimum of accessibility needs as determined by Offsite by Advanced Design at their sole discretion. Offsite by Advanced Design will to its best ability and within reason accomodate students with special needs who make those needs expressly known in the application process.


11. NOTIFICATION OF CHANGES
Offsite by Advanced Design reserves the right at its sole discretion to make changes to educator line up, course material, scheduling, and any and all other content. Offsite by Advanced Design will notify students to the best of its ability within reason at its sole discretion of any such changes should they occur.


12. CODE OF CONDUCT
All students, instructors, and organizers are required to agree with the following code of conduct. Organizers will enforce this code of conduct throughout the duration of the course offering. We expect cooperation from our students, instructors, and organizers to ensure a safe environment for all those enrolled and engaged with Offsite.

Harassment includes offensive verbal comments related to gender, gender identity and expression, age, sexual orientation, disability, physical appearance, body size, race, ethnicity, religion, technology choices, sexual images in public spaces/ online, deliberate intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other events, inappropriate physical contact, and unwelcome sexual attention.

Participants asked to stop any harassing behavior are expected to comply immediately.

Organizers associated with Offsite are also subject to the anti-harassment policy. In particular, sponsors should not use sexualised images, activities, or other material. If a participant engages in harassing behavior, the organizers may take any action they deem appropriate, including warning the offender or expulsion from the program with no refund.

If you are being harassed, notice that someone else is being harassed, or have any other concerns, please contact a member of the Offsite team, or notify a member of our experience team.

At Offsite, we value and encourage the creative exploration and curiosity of our students, allowing them the freedom to design as they see fit. However, this freedom is accompanied by a sense of responsibility. It is imperative to acknowledge that while design is a form of expression, the objects created can have significant implications, including the potential for harm. Therefore, while we do not restrict our students' creative choices, we strongly advocate against the creation of work that promotes or glorifies violence in any form, including comedic or satirical representations.

We want to make it clear that if a student chooses to apply the skills learned here to design objects such as weapons in the future, this decision is entirely their own and should not be associated with our coursework or institution. We emphasize that our name and brand should not be used to endorse or represent such activities.

We expect participants to follow these rules in all Offsite and Advanced Design channels.
